"Just because it's the law, does not mean it is Constitutional"

On the front page of Sunday's RTD was an article "Everyone not falling in line with 2010 census" that featured quotes from Richmond Patriot, Laura Alcorn. Ms. Alcorn said she did return her 2010 Census form with the number of people in her household and their names. But she, also noted "I think they are overreaching in what they're asking. . . . I think it's an invasion of my privacy." So I guess that not filling out all the question is what is meant by "not falling in line."

In the same article, political analyst Larry Sabato stated:

"I think it's more intense than I've seen it before," Sabato said of concerns about the census. "People are deeply skeptical and cynical. I don't think there's any justification for being skeptical or cynical, and it's the law" to provide all information requested for the census.

O.k. so let's concede that it is the law:

Mr. Sabato also noted:

What are they doing? They're driving up the costs of government because the census worker is going to have to come to their home personally to get all the questions answered," he said.

Driving up cost.... REALLY?

Republicans set to block uses of "Slaughter Solution"

Tuesday, Rep. Parker Griffith(R AL-05) introduced a House resolution that would block the Speaker Pelosi from using the "Slaughter Solution", which is a procedural rule to pass health care reform. The resolution would require an up or down vote on the actual Senate Health Care Reform bill.

"It's an easy resolution and very straight forward," explains Griffith. "It allows the American people to know where each Congressman or Congresswoman is on the issue and keeps the confusion out of the vote."

Here is the proposed text:

Ensuring an up or down vote on certain health care legislation.

Resolved, That the Committee on Rules may not report a rule or order that provides for disposition of the Senate amendments to H.R. 3590, an Act entitled The Patient Protection and Affordable Care Act, unless such rule or order provides for—

(1) at least one hour of debate, equally divided and controlled by the Majority Leader and the Minority Leader, or their designees; and

(2) a requirement that the Speaker put the question on disposition of the Senate amendments and that the yeas and nays be considered as ordered thereon.

It looks like this vote will take place Thursday around 11:00am.

Stay tuned....

Sorry, RPV, we are *WAY* passed reading the bill.

The fact of the matter is that the Health Care bill probably be passed this week or next, whether it is the will of the people or not. Pelosi is determined to deliver a bill to President Obama, even if the House has to used the made up rule called the "Slaughter Solution". So what is the Republican Party of Virginia doing to bring awareness to this fact? Enlisting volunteers to read the bill. Really.

RPV Chairman Pat Mullins issued the following statement about this week’s expected vote on the Obama/Pelosi Healthcare Legislation. Here is an excerpt:

"That's why on Wednesday at 8 a.m. folks from all across Virginia will start to read all 2,400 pages of this healthcare takeover bill. Volunteers will read each and every page and will read in 30 minute shifts. Any Virginian who really wants to know what’s in this healthcare bill and learn why it is a bad deal for our state is invited to listen in. We will be streaming the volunteer reading of the bill live on our website at: We would also encourage Congressmen Nye, Perriello, Connolly, and Boucher to listen themselves and learn why this bill is bad medicine for their constituents.

This is as mind numbing as listening to another Obama speech rallying support for the bill.

HELLO, RPV where on earth have you been? Patriots have been reading the bill since last summer. Any engaged citizens KNOWS what is in the bill. Congressmen Nye, Perriello, Connolly and Boucher are NOT going to be listening in, they also know what is in the bill.

But I am willing to cut the RPV a little slack. I remember last summer when the patriot movement was coming together, each month we would have a group of newly awakened patriots coming up with some creative ways to get our representatives attention. I think at one point there was even talk of a "die in".

So hopefully by now you are getting my point. While our frustration is running high we tend to get in a panic mode and we look for outlets for those frustrations. Reading the bill sounds like a great idea it really is just a distraction and it will not, in the end, change anything.

Speaker Pelosi's problems are with the Democrats, not the Republican. The Democrats have the majority, something they seem to want us to forget. That is why she has to use what Senator Chris Dodd (D) is referring to as "exotic procedural move". Make no mistake they are pulling out all the stops and it will be up to the American people (not the republicans) to clean up this mess.

Republicans acting like the "good" child

House Republicans have put a self imposed ban on all earmarks for the rest of the year. This is an attempt to expose the "back room" deals the Democrats are making to get health care reform passed.

“No doubt earmarks are being talked about in a different way by the democratic majority,” said Rep. Mike Pence, the chairman of the Republican Conference, from Indiana.

Pence said Democrats were cutting “backroom deals” to persuade reluctant House Democrats to vote for the president’s proposal, and said “the American people want us to change business as usual.”

House Minority Whip Eric Cantor, Virginia Republican, said that Democrats’ promises to clean up Washington politics “is being broken every day.”

Don't get me wrong, I think this is a good thing, but why now?? Because it is politically expedient. Anyone who has siblings is all to familiar with this tactic, you merely stay out of trouble and do what you are suppose to while your brother is in trouble and you are consider the "good" child.

Let's hope the ban last longer than the election year!

This morning I met the Lt. Gov. of VA

This is what happens when you show up to your local political party meetings. You get the opportunity to speak one on one and face to face with your government officials. Today, at the Henrico GOP Breakfast, LG Bill Bolling spoke and he took a moment before hand to greet people at their tables. He also took a moment to answer few questions.

So next time you see a party meeting posted don't roll your eyes, go! You might learn something or even meet someone.

URGENT ACTION ALERT: Griffith is Stalling #va #hb69 #rva912

From Donna Holt, Va State Director Campaign for Liberty:

Dear Friends of Liberty,

Morgan Griffith claims he cannot substitute the language of SB501 with the language of HB69 saying "it is not germane".

Don't be fooled! It is germane if the Speaker says it is.

Both bills deal with the same Code of Virginia and are about firearms.

What else does he need for it to be germane?

Contact Speaker Bill Howell and Delegate Morgan Griffith NOW and tell them it is the will of the people that is at stake and we won't settle for excuses to not do what's right.

Senator Marsh has set up HB69 to die in his subcommittee which is against Senate rules. The bill deserves to be fully vetted and if the Senate won't do it, it's the obligation of the House to get the bill that they passed with a bi-partisan vote of 70 - 29 on the floor for a vote even if it means it has to be a concurrence vote.

Jamie Radtke sent an excellent letter to serve as an example for a suggested script.  Here is an edited (for the coalition) version of the letter:

Dear Speaker Howell and Delegate Morgan,

As you know, Henry Marsh has decided to kill all gun bills in his subcommittee against senate rules. It has been determined that the only way to resurrect HB69, Firearm Freedom Act, is to offer it as a substitute to one of the senate bills in the House. The VA 10th Amendment Revolution, consisting of mostly tea party groups,  had only two bills in the General Assembly (HB10, HB69). We will not let this bill go down without a fight and would greatly appreciate your assistance.

We have researched the bills and believe that SB501 is germane. SB501 and HB69 come from the exact same section of the Code 18.2-308 and deal with firearms. I understand that you believe this is not a germane bill. However, I also know this comes down to the ruling of the Speaker.

If I may be so bold, the infamous HB3202 Transportation bill of 2007 was an abomination of a bill that clearly violated the single object rule. It had everything in it from land use, VDOT reform, retroactive abuser fees, establishment of regional transportation authorities and more. It was determined that this bill was acceptable under the single object because it all fell under the umbrella of transportation. What we are dealing with here are two bills that deal with firearms out of the exact same section of the Virginia Code. This is not a stretch at all.

Speaker Howell, we are very grateful that you co-sponsored this bill.

Delegate Griffith, you have expressed a willingness to offer an applicable substitute. This bill is very important to the VA 10th Amendment Revolution. We are looking to you to carry this bill over the victory line.

A "big enough" Health Care Bill

In President Obama's State of the Union speech on Jan 27, 2010 he stated:

"... for every success story, there are other stories, of men and women who wake up with the anguish of not knowing where their next paycheck will come from; who send out resumes week after week and hear nothing in response. That is why jobs must be our No. 1 focus in 2010..."

Yet, here we are March 2nd and the focus is still on how to pass the health care bill.

"In a matter of days, we will have a proposal," Pelosi said, pointing to Obama's forthcoming bill. "It will be a much smaller proposal than we had in the House bill, because that's where we can gain consensus. But it will be big enough to put us on a path of affordable, quality health care for all Americans that holds insurance companies accountable."

So how big is big enough? Big enough to get the votes in the Senate?

White House and Democratic sources hasten to add late today that House Speaker Nancy Pelosi did not mean to suggest the new plan would constitute a retreat from comprehensive health care reform.

Pelosi spokesman Nadeam Elshami said the speaker was trying to say the new Obama health care proposal would take its policy cues from the Senate health bill and the ideas Obama posted online a week ago.

Elshami did not deny Pelosi's comments about a "much smaller" bill could fairly be interpreted as suggesting a step back from the Senate bill. Instead, Pelosi has come to regard the Senate bill itself as "much smaller" than the House bill, Elshami said.

White House officials also said Obama's not dramatically scaling back his proposal. No one was prepared to discuss a price tag, but it appears the ballpark 10-year figure of $1 trillion remains.

The revisions, it appears, will focus on adding GOP ideas on tort reform and selling insurance across state lines

At this point we really don't know what will be in the proposal, we have to wait until Wednesday.

However, last week before the Health Care Summit, I had this post showing the Democrat Senators letter urging Majority Leader Reid to go "nuclear" and pass the bill using budget reconciliation rules. Also noting that a White House spoke person indicating the "new" bill was being written so it could be attached to a budget bill. This makes me extremely uneasy and add to that again another Nancy Pelosi quote:

But top Democrats are signaling that that may be the price to pay for a historic piece of legislation that could fundamentally reshape the health care industry.

Asked Sunday what she says to members afraid of losing their seats in November, Pelosi said, "We're not here just to self-perpetuate our service in Congress. We're here to do the job for the American people."

Now as frustrating as this is please remember Health Care Reform was suppose to have been a done deal before August break, then by Columbus Day, then by Thanksgiving, then it sort of passed but had to go into reconciliation. Then, let's not forget Scott Brown. We have met Health Care Reform every step of the way, now can we make until Easter Break with out a vote. Please pray for time!
